Changes to animal licensing
From 1 October 2018 animal licensing is changing and the government is introducing a single type of licence covering businesses providing animal - related services.
You will require an 'animal activity licence' if you:
- sell animals as pets
- provide for, or arrange for the provision of boarding for cats or dogs (including boarding in kennels, catteries, home boarding for dogs and day care for dogs)
- hire out horses (whether for riding lessons or not)
- breed dogs (3 litters a year or more)
- breed, keep or train animals for exhibition (including performance)
There is also a business threshold test which applies if you earn more than £1,000 or earn a commision or fee from one of the specified business activities. (This means for dog breeders you may only have one litter but if you earn more than £1,000 you will need a licence.)
If you currently hold a licence with the Council, it will run until it's expiry date on 31st December 2018. You will need to apply to renew your licence at least 10 weeks before it is due to expire to give opportunity for officers to carry out an inspection and provide you with a report which will include the star rating allocated to your business.
At present we do not have the required application form as this has not yet been published by DEFRA, but we will send out reminders as soon as we can.

Before being granted a licence, the applicant must be able to demonstrate to the council's animal licensing inspector that the following measures are in place:
- that they have a specialist knowledge in the species that they are caring for and a clear understanding of its needs and welfare. This will include the animals' mental and physical health, feeding and knowledge of environmental enrichment. The applicant should be able to demonstrate that they have researched and followed expert guidance in order to carry out their role.
- that there are comprehensive records that contain all the information required by the conditions that apply to their particular activities.
- that they have an understanding of the risks involved in caring for the animal, including an extensive assessment and written policies and procedures that are reviewed regularly. Their documents must be available for the Inspector to examine.
- that there are training procedures in place to make sure staff know what is expected of them, and clear evidence of good supervision of staff.
This list is not exhaustive.
The premise itself will also be assessed so we can be sure the licence holder can meet the new laws relating to the physical environment in which the animals will be kept.
Based on this information, we will assess the risk rating and determine the period the licence will be granted together with the star rating awarded.
A licence application may be refused if the minimum standards are not met.
Your right of appeal
Any operator who is aggreived by a decision by a local authority -
(a) to refuse to grant or renew a licence, or
(b) to revoke or vary a licence,
may appeal to the First-Tier Tribunal.
Offences and penalties
(1) It is an offence for a person, without lawful authority or excuse
(a)to breach a licence condition;
(b)to fail to comply with regulation 7 or 19.
(2) A person who commits an offence under paragraph (1) is liable on summary conviction to a fine.
