Tackling anti-social behaviour and hate harassment

When council tenants sign their tenancy agreements, they agree not to cause nuisance or annoyance to anybody else who lives in, works in, or is visiting their neighbourhood.

Tenants are also responsible for the behaviour of their visitors and family members who should behave in a reasonable manner.

We can also take action against people who are not council tenants but are causing nuisance or harassment to people living in council homes.

What is a nuisance?

Nuisance is a general term to include all types of unacceptable behaviour that makes other people uncomfortable and stops them enjoying living in their own homes. For example:

  • playing loud music
  • dumping rubbish
  • tetting dogs bark and foul in the street 
  • being drunk in the street

It can also include more serious things, such as violent or criminal behaviour and drug dealing.

What is harassment?

Harassment is deliberate behaviour intended to intimidate, dominate or harm an individual. Hate harassment is harassment from people that is directed towards those who they think are different from them because of the victim's racial background, disability, illness, religion, sexuality or age.

Housing Services' response to anti-social behaviour

Housing Services will look at the best way of stopping the behaviour. This may involve one or more of the following:

  • Talking to the person who is experiencing the anti-social behaviour and to the person causing it
  • Keeping the victim informed of what is happening in the investigation and arranging appropriate support for them
  • Working with other agencies to find evidence and stop the behaviour, eg, the police and environmental services 
  • Using professional witnesses to gather evidence and to act for the department in any legal action
  • Using all legal remedies available to us. This would include the use of, for example, injunctions, Anti-Social Behaviour Orders and Possession Orders.

Please note: If you are evicted because of anti-social behaviour, the council may not rehouse you under homelessness legislation and you may be excluded from our waiting list.

If you, or any member of your household, or visitors at your property, have a problem caused by anti-social behaviour, please report this to the Neighbourhoods Team.

Working together against hate harassment

Chesterfield Borough Council wants all of its customers to lead lives unspoilt by harassment or abuse because of their colour, race, nationality or national origin.

The council will not tolerate any form of hate harassment – whether it is:

  • verbal abuse
  • physical attacks on people or property
  • racist slogans
  • rubbish, etc. put through letter boxes
  • racist leaflets

What can we do?

  • We will work to persuade the people who are harassing you to stop. This could, if you want, involve the police.
  • We can take legal action against them; if they live in one of our houses, we can evict them if they don't stop.
  • We can make your home more secure and fit an emergency alarm to make you feel safer.
  • We can consider finding you another home.
