The council’s proposed Charging Schedule, regulation 123 list and exceptions policy were considered at a meeting of the Full Council on Thursday 14 October 2015, with a recommendation that the council begin collection of CIL from 1 April 2016.

Below is the process that the council has taken to introduce the Community Infrastructure Levy.
The Examiner’s report has been received by the council. The Examiner concluded that:
“In setting the CIL charging rate the Council have had regard to detailed evidence on infrastructure planning and the property market in the borough, and have carried out robust viability appraisals based on sound assumptions. The Council’s approach is realistic in achieving a reasonable level of income to address an acknowledged gap in infrastructure funding, while ensuring that development remains generally viable across the borough.
I conclude that the Chesterfield Community Infrastructure Levy Charging Schedule satisfies the requirements of Section 212 of the 2008 Act and meets the criteria for viability in the 2010 Regulations (as amended). I therefore recommend that the Charging Schedule be approved.”
The four-week period of consultation has now ended. The responses from the consultation have been forwarded to the Examiner. Any issues raised in the responses will be considered before he issues his report.

Consultation responses received by 13 October 2014
A hearing session for the Examination of Chesterfield Borough Council’s Community Infrastructure Levy (CIL) Draft Charging Schedule was undertaken on Tuesday 12 August 2014 by an Examiner appointed by the Planning Inspectorate. With the approval of the Examiner, the council is now consulting on a set of proposed changes to the CIL evidence base. The changes include the following:
These proposed changes will be subject to a four week period of consultation starting on Monday 15 September 2014 and ending at 5pm, Monday 13 October 2014. The revised documents and CIL consultation material will be available at the locations set out below.
Representations on the revised CIL evidence base must be made within the specified period. Representations should be sent in writing to the following addresses:

Copies of representations will be made publicly available on the council’s website and can be inspected at the Council offices. They cannot therefore be treated as confidential.
Please note that any representations should relate ONLY to the proposed changes. If you made previous representations then these have already been considered by the Examiner conducting the Public Examination.
What happens next?
All representations received will be collated and sent to the examiner as soon as possible after the consultation period ends. The examiner has indicated that he will take into account any representations made on the revised evidence base before reporting to the council.

The hearing session will commence at 9.30am on Tuesday 12 August 2014 and will be held in Committee Room 2, Chesterfield Borough Council, Town Hall, Rose Hill, Chesterfield, Derbyshire, S40 1LP. The Examiner does not expect the hearing to continue into a second day. However, the room has been booked for Wednesday 13 August if further time is required.

The council submitted its CIL Draft Charging Schedule to the Planning Inspectorate for Independent Examination on 13 June 2014. Mr Roger Clews (BA MSc DipEd DipTP MRTPI) has been appointed as the independent Examiner.

Draft Charging Schedule
In line with Regulation 16 and 17 of the Community Infrastructure Regulations 2010 (as amended) the council consulted on a Draft Charging Schedule and supporting documents from 14 November 2013 to 13 January 2014. All the consultation comments were taken into account by the council prior to submitting the Draft Charging Schedule to the Planning Inspectorate. The comments and council response can be viewed in the Regulation 19 (b) Statement of Consultation (May 2014), which is referenced as document SD1 in the above submission list.
Preliminary Draft Charging Schedule
In line with Regulation 15 of the Community Infrastructure Regulations 2010 (as amended) the council consulted on a Preliminary Draft Charging Schedule and supporting documents from 3 June 2013 to 15 July 2013. All the consultation comments were taken into account by the council prior to preparing a Draft Charging Schedule.
